Just saw the NYT News Alert on this pop into my inbox, whooped for joy, posted it on my Facebook and then came here 'cause, you know, I'm sitting at home alone after a long day but this is a thing worth sharing with others. Still a long way to go. But this is a good step.

But Democracy loses.

Regardless of my, your and/or anyone else's opinion/view on "gay" marriage it is wrong for a Judge, particularly an unelected one, to overturn a law that was passed in an open and free election by the majority of citizens. It is the same type of wrong as when elected representatives ignore the wishes of those that elected them as in the passage of the "Health Care Bill" recently. It is just plain wrong, no matter what the issue/law may happen to be. Just saying

Prop 8 represented the people voting on whether a particular class of people deserved equal rights under the law. Would you be as willing to accept such a matter if the vote had been about the rights of people or color? Or the right of anyone to enter into an interracial marriage?

A government that thinks it valid to hold a vote as whether some of its citizens are as human as some of its other citizens does not deserve the honor of representing anyone.

I do not buy into that argument that you state above. By that I mean that I do not think anyone on either side (other than maybe a minority of extremists) are declaring that Gays are not human as non Gays. But I'll leave it at that for the sake of not getting into a heated argument or possibly being misunderstood which is never a good thing. I stand by my opinion in my comment.

As a resident of the state of California, let me explain something that might not be clear to nonresidents (I'm not being snide, but sometimes you just had to be on the ground here in My State for the firefight to truly understand).

Proposition 8 sought to limit the civil a rights of class of individuals in California by denying them their constitutional rights. Whether that class of individuals was gay (no irony quotes), Latino, female or albino is utterly immaterial.

I repeat: *Proposition 8 sought to limit the civil rights of a class of individuals by denying them their constitutional rights.

Whether you like it or not -- whether you agree or not -- civil rights are NOT decided by a majority vote.

The law says I am not allowed to marry. Why is that? It's not because the law treats me as an equal.

Those who fight against gay marriage say it is because my getting married would be the same as marrying a dog.

As others have said, please educate yourself: about the purpose and history of the US courts, about the systematic dehumanization of sexual and other minorities throughout US and world history, and about your damn privilege.
