Regardless of what you think about the prominence of marriage in LGBTQ activism in the US right now, this ruling will absolutely, positively determine the shape of the fight for a while as well as decide who has the momentum right now.

It's big, it's critical, and it's, quite frankly, bloody terrifying.

And it's happening tomorrow sometime between 1pm and 3pm PST.

I'm so nervous, I can't even handle it. I've never felt so scared about a political ruling in my life. Living in California, being a part of the campaigns ... it's a bit overwhelming.

There's going to be a little rally in my area, regardless of outcome, but I just hope we'll all be celebrating.

My son is the prez of his school's GSA, he's been following this very, very closely. He's working at a resort for the summer and has limited access to TV/internet. He'll find the tracker very helpful.

Really? I'm a worrying sort of person, and I haven't heard a single thing during the trial that would lead me to think that the haters aren't going to get their asses handed to them in four part harmony with full orchestration.

This is what I'm envisioning. I followed the trial pretty closely, and got the very distinct impression that the court was thoroughly unimpressed with the pro-8 arguments.

I am cautiously optimistic.

The pro-8 folks seem to be of the same opinion. The Advocate reported last night that they've already got a motion to stay filed, anticipating that they'll be appealing the decision. I'm not sure what that entails, but it *sounds* like they want to make sure no marriages are allowed to happen in between today's ruling and their appeal.

That's exactly what that is, yes.

My Boss (one of them, anyway) and I have been talking about the case (he's an attorney), and he expects that Vaughn Walker himself will issue a stay on the ruling, until it has been heard by the Ninth. That could take up to a year, and there's no doubt in his mind that if the Ninth also finds Prop 8 unconstitutional, it will head for the USSC. That will take another year.

That said, it's entirely likely, given the current Court's makeup, that Prop 8 will be struck down by the USSC, hammering home the final "STFU, Haters!" nail in the coffin.

Given the blatant violations of the Constitutions Equal Protections clause, I can't see this playing out any other way. But of course, stupider things have happened, so I'm keeping my caution.

Thanks. I suppose it makes sense that that is how it would play out, but it's frustrating that it should take so long and still have the potential margin for going wrong.

It's distressing, to be sure.

BUT! Once it goes to the USSC and the USSC strikes that abomination down, it's over. When the haters pipe up with their crying again, the USSC gets to say "What part of NO is beyond your grasp, dumbass? ALL citizens have the right to marry, whether you like it or not, so go lie down."

And that will be WONDERFUL.

I want to have hope. I know that even if 8 gets knocked down, there will be appeals and a long road still ahead. But I would be so happy still. Because it's a step and a statement.

And I'll bet the rest of my office today has no clue this is even on the schedule...
